I think there are obvious limits to this, like refusing to sell to someone because they are black, but I believe they are within their rights if you tell them you are going to return it.
Now retailers refusing to sell something Nintendo offers as a separate product unless you buy something else (ie, a bundle), does seem very shady, and I've e-mailed both Nintendo and other retailers to let them know I feel this way.
